1. The President and Secretary of the Board are hereby authorized to execute an agreement with Parker McCay, P.A.

RESOLUTION

WORKERS COMPENSATION

1. Ronald Bartash, Esquire of the law firm of Naulty, Scharicamazza and McDevitt, LLC  is hereby retained to provide the legal services necessary in connection with resolving disputes concerning workers’ compensation claims made by employees and/or former employees of the Board of Education;

2. The Contract is awarded without competitive bidding as a “Professional Service” in accordance with the Public Schools Contracts Law, N.J.S.A. 18A: 18A-5(a)(1), because it is for services performed by persons authorized by law to practice a recognized profession; and,

3. A copy of this Resolution, as well as the Contract, shall be placed on file with the Secretary of the Board of Education.

Professional Services Contract

1. The Board engages the services of Naulty, Scharicamazza and McDevitt, LLC  to provide special legal services necessary in connection with resolving disputes concerning employees and/or former employees seeking workers’ compensation benefits who shall be referred to herein as “Petitioners”.

2. The services of Special Counsel will include, but shall not specifically be limited to, telephone and/or person-to-person consultation and legal advice, research, analysis, investigation or related activity, and representation of the Board before all Federal and State Courts, Administrative Courts and Bodies in connection with the workers’ compensation disputes.

3. The Board agrees to pay Special Counsel and other lawyers at the firm of Naulty, Scharicamazza and McDevitt, LLC for professional services at an hourly rate of $125.00 per hour for all work performed and to pay for all out-of-pocket expenses incurred in connection with such workers’ compensation matters.  Examples of such expenses include, but are not limited to: long-distance telephone calls, photocopying, postage, publication of notices, and computerized legal research.

4. Special Counsel shall submit itemized bills to the Board for payment of services on a monthly basis.

1. The President and Secretary of the Board are hereby authorized to execute an agreement with Dr. Josette Palmer, M.D, for School Physician Services.

2. This contract is awarded without competitive bidding as a professional service under the provisions of the Local Public Contracts Law because N.J.S.A. 18A: 18 A-5 permits contracts for professional services to be awarded without competitive bidding.
