NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Borough of Glassboro, Gloucester County, New Jersey, as follows:
 
  1. The President and Secretary of the Board are hereby authorized to execute an agreement with Parker McCay, P.A.
 
  1. This contract is awarded without competitive bidding as a professional service under the provisions of the Local Public Contracts law because N.J.S.A. 18A: 18A-5 permits contract for professional services to be awarded without competitive bidding.
 
  1. Parker McCay, P.A. as School District Solicitor for General Legal Services at an hourly rate of $170 per hour.

RESOLUTION

WORKERS COMPENSATION

 
 
SUBJECT:     Award of Contract for Professional Services by Special Counsel.
 
WHEREAS,   There exists a need for legal services by the Board of Education for the Borough of Glassboro Public Schools in the Borough of Glassboro, County of Gloucester, State of New Jersey, in connection with a dispute concerning claims for workers’ compensation by several employees and/or former employees of the Board; and
 
WHEREAS,   such special legal services can be provided by Ronald Bartash, Esquire of the law firm of Naulty, Scharicamazza and McDevitt, LLC; now, therefore,
 
BE IT RESOLVED BY THE BOARD OF EDUCATION FOR THE
GLASSBORO PUBLIC SCHOOLS AS FOLLOWS:
 
  1. Ronald Bartash, Esquire of the law firm of Naulty, Scharicamazza and McDevitt, LLC  is hereby retained to provide the legal services necessary in connection with resolving disputes concerning workers’ compensation claims made by employees and/or former employees of the Board of Education;
 
  1. The Contract is awarded without competitive bidding as a “Professional Service” in accordance with the Public Schools Contracts Law, N.J.S.A. 18A: 18A-5(a)(1), because it is for services performed by persons authorized by law to practice a recognized profession; and,
 
  1. A copy of this Resolution, as well as the Contract, shall be placed on file with the Secretary of the Board of Education.
 
I certify that the foregoing Resolution was adopted at a regular meeting of the Glassboro Board of Education on January 4, 2017.

Professional Services Contract

Workers Compensation
 
 
            THIS AGREEMENT is made this 4th day of January 2017 between the GLASSBORO BOARD OF EDUCATION (hereinafter “Board”) and Ronald Bartash, Esquire, of the law firm of Naulty, Scharicamazza and McDevitt, LLC (hereinafter “Special Counsel”).
 
            In consideration of the mutual covenants hereinafter contained, it is mutually agreed by and between the parties as follows:
 
  1. The Board engages the services of Naulty, Scharicamazza and McDevitt, LLC  to provide special legal services necessary in connection with resolving disputes concerning employees and/or former employees seeking workers’ compensation benefits who shall be referred to herein as “Petitioners”.
 
  1. The services of Special Counsel will include, but shall not specifically be limited to, telephone and/or person-to-person consultation and legal advice, research, analysis, investigation or related activity, and representation of the Board before all Federal and State Courts, Administrative Courts and Bodies in connection with the workers’ compensation disputes.
 
  1. The Board agrees to pay Special Counsel and other lawyers at the firm of Naulty, Scharicamazza and McDevitt, LLC for professional services at an hourly rate of $125.00 per hour for all work performed and to pay for all out-of-pocket expenses incurred in connection with such workers’ compensation matters.  Examples of such expenses include, but are not limited to: long-distance telephone calls, photocopying, postage, publication of notices, and computerized legal research.
 
  1. Special Counsel shall submit itemized bills to the Board for payment of services on a monthly basis.

WHEREAS,               There exists a need for designated Professional Services for
Asbestos Hazard Emergency Response Act; and
 
WHEREAS,               Funds are available for this purpose; and
 
WHEREAS,               The Local Public Contracts Law (N.J.S.A. 18A: 18A-5) requires a resolution authorizing the award of contracts for professional services without competitive bids.
 
 
NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Borough of Glassboro, Gloucester County, New Jersey, as follows:
 
  1. The President and Secretary of the Board are hereby authorized to execute an agreement with Environmental Design, Inc. in the amount of $2,500 plus any additional cost for specific projects.
 
  1. This contract is awarded without competitive bidding as a professional service under the provisions of the Local Public Contracts law because N.J.S.A. 18A: 18A-5 permits contract for professional services to be awarded without competitive bidding.
